Unit Description

This is a foundational unit, providing students with a broad understanding of legal processes. The unit takes an historical and comparative approach in developing an understanding of the Australian common law legal system. Constitutional structures and the principal sources of law will be considered. These issues will be further developed in the unit Comparative Legal Systems. Topics examined in this unit include:

Doctrine of precedent
Statutory interpretation
Legal analysis and writing

Unit Learning Outcomes

1.	Identify, understand and critically analyse the historical and jurisprudential development of the Australian legal system
2.	Analyse statutes and apply the principles of statutory interpretation to novel fact situations
3.	Discuss and evaluate the development of legal processes and principles in a transnational and comparative context.
4.	Extract the important aspects of judgments and apply relevant principles to novel fact situations
5.	Demonstrate a capacity for legal research and writing and critical analysis.
