This unit includes an overview of environmental and planning law as it currently exists in the Northern Territory, federally and internationally. It will examine philosophical underpinnings and commonwealth environmental law, as well as some of the key areas of pollution control and planning law in the Northern Territory.
This area of law is evolving rapidly. This unit will examine trends in the development of environmental law and consider future directions. It will examine the law in the context of the political debate surrounding environmental issues. Questions posed throughout the unit will be:
- What is the law in this area trying to achieve?
- Is the law achieving its objectives?
- What developments in the law can be expected in the future?
Attention will also be given to the development of international environmental law particularly as this relates to climate change and the strong influence that this is having on Australian law.
